These terms govern the professional relationship between Growtica and the Client. By engaging our web development services, you agree to the following conditions.
1. Scope of Work (Project Boundaries)
We provide custom web development, UI/UX design, and digital solutions as defined in the initial project proposal. Any additional features or “scope creep” requested after the project start will be subject to additional billing and adjusted timelines.
2. Payments & Deposits
- Initial Deposit: A non-refundable deposit of [50%] is required before any development work begins.
- Milestone Payments: Final delivery of the website/project is contingent upon the receipt of the remaining balance.
- Late Fees: Delayed payments may result in a temporary suspension of development or hosting services.
3. Intellectual Property (Ownership)
- Client Content: The Client retains all rights to any text, images, or data provided to the Agency.
- Source Code Ownership: Upon full and final payment, the ownership of the custom-built website and its source code is transferred to the Client.
- Agency Portfolio: The Agency reserves the right to showcase the completed project in its portfolio and marketing materials unless otherwise agreed upon in writing.
4. Client Responsibilities
The Client must provide all necessary assets (logos, content, credentials) in a timely manner. Delays in providing these assets will result in a corresponding shift in the project completion date.
5. Post-Launch Support & Warranty
We provide a [30-day] bug-fix warranty after the website launch to ensure everything functions as intended. Ongoing maintenance, security updates, and hosting after this period are available through our monthly support packages.
6. Limitation of Liability
Growtica will not be liable for any indirect, incidental, or consequential damages (including loss of profit or data) arising out of the use or inability to use the developed website or services.
7. Termination
Either party may terminate the contract with written notice if the other party breaches these terms. In the event of termination, the Client will be billed for all work completed up to the date of notice.
